$150 million - Largest personal injury verdict in California history
The Law Offices of Brian Brandt has obtained some of the largest verdicts for personal injury victims in California and throughout the country. Since becoming a lawyer in 1987, attorney Brian Brandt has secured hundreds of millions of dollars in verdicts and settlements for injury victims and their families.
These large sums serve a vital purpose. Brian has seen the toll that accidents can take on victims and their families. He knows that getting the highest settlements and verdicts possible can help them rebuild their lives. In most cases, the money obtained for accident victims goes toward their medical expenses and lost income due to not being able to work for weeks or months - or perhaps ever again - after an accident.
The sizable settlements and verdicts we obtain also send a strong message. When an accident is caused by the reckless or negligent behavior of another person or corporation, our job is to help send a loud and clear message that such behavior will not be tolerated anywhere in California.
The following verdicts and settlements represent some of our most noteworthy case results, including the largest wrongful death verdict in the history of California. These settlements and verdicts include:
- $150.75 million wrongful death verdict
- $23.4 million for car accident victim
- $4.5 million for medical malpractice
- $1.5 million for medical malpractice
- $1.5 million for premises liability accident victim
- $1.3 million for motorcycle accident victim
- $1.3 million for motorcycle accident victim

- Brian Brandt Wins $150 Million Verdict for Young Client.
The Law Offices of Brian Brandt, representing the plaintiffs in a wrongful death lawsuit, fought vigorously for young victim Kylie Asam and her brother, Blaine, who was 14 years old when he died on June 6, 2013. On November 22, 2009, Kylie and Blaine witnessed both parents, Michael, 41, and Shannon, 40, as well as their 14-year-old brother, Brennan, burn to death in a horrific truck collision on the 210 Freeway, just east of the Sunland Boulevard exit in Southern California.
Truck driver Rudolph Ortiz, who was driving for Watsonville-based Bhandal Bros. Trucking Inc., had pulled his 18-wheeler off the 210 Freeway and onto the shoulder. Mr. Ortiz did not turn on the lights of the truck or put out reflectors when he stopped. The Asam family was driving in a GMC Yukon, pulling a utility trailer. At approximately 5 a.m., Mr. Asam hit a piece of debris, causing the left front tire of the trailer to blow out. In an attempt to make an emergency stop, Mr. Asam pulled onto the shoulder of the freeway and crashed into the back of the Bhandal Bros. Truck. The three victims-Mr. and Mrs. Asam and young Brennan-became trapped when the vehicle got stuck under the truck. Only Kylie and Blaine managed to escape through a broken rear window before the Yukon caught fire.
A motorist who stopped to help tried using a fire extinguisher, dousing the engine with dirt, and calling authorities twice. The motorist also attempted to free Mrs. Asam, who was pleading for her life, but the fire spread quickly and engulfed the vehicle. During this entire frightening ordeal, Mr. Ortiz remained in the truck's cab.
As lead counsel, Orange County lawyer Brian Brandt brought a wrongful death lawsuit on behalf of Kylie and Blaine, with Kylie as successor-in-interest following her brother's death. Recovery was also sought for negligent infliction of emotional distress because of watching her family members burn to death.
The Law Offices of Brian Brandt filed suit against the driver and Bhandal Bros. Trucking Inc., with Carolina Casualty as the insurance carrier. The case went to trial, and Brian called countless witnesses, including a tire engineer, highway safety engineer, neurologist, trucking expert, accident reconstructionist, psychologist, and economist. The truck driver, who had his license for two years at the time of the fatal crash, told the jury at least three different stories as to why he had pulled over on the side of the freeway, including having to sleep, having to urinate, and suffering from a headache. The jury did not find Mr. Ortiz credible, and in closing arguments, Brian asked for $130 million in damages due to the negligent actions of the driver.
The jury deliberated for three days and found the defendants fully at fault. The jury returned with a significant verdict of $150,750,000 in favor of the plaintiff; this verdict included $8.75 million awarded to Blaine. Brian obtained a verdict that was $20 million more than originally requested. Thanks to the continued work of The Law Offices of Brian Brandt, Kylie's financial future is taken care of, and the defendants have been held accountable for their negligent actions.
